On November 12th, 2018, SIP Lvse Jiangnan Public Environment Concerned Centre (hereinafter referred to as “PECC”) received a report on the environmental pollution of Dailou Industrial Concentration Zone from residents of Jinhu County, Huai’an City, Jiangsu Province through WeChat. On December 12th, PECC reported the information to the Environmental Protection Bureau of Jinhu County.
On December 18th, 2018, PECC received a written reply from Jinhu Environmental Protection Bureau.
As early as March 12th, 2018, the Environmental Protection Bureau of Jinhu County had received a report from the public that the polluting enterprise is the “Jinhu Zhuochuang Waste Material Recycling Department” that has carried out processing and production of waste plastics without approval procedures for environmental impact evaluation (EIA) and supporting facilities about environmental protection. On March 27th, 2018, the bureau issued the “Prior Notice of Administrative Penalty (Hearing) by Environmental Protection Bureau of Jinhu County” (Notice of Jinhuan Penalty [2018] No. 9); On April 16th, 2018, the “Decision on Administrative Penalty by the Environmental Protection Bureau of Jinhu County” (Notice of Jinhuan Penalty [2018] No. 11) was issued, and the material recycling department was fined 200,000 yuan and ordered to make up the approval procedures for EIA; On June 11th, 2018, “Jinhu Zhuochuang Waste Materials Recycling Department” filed an administrative reconsideration with Huai’an Environmental Protection Bureau, and on July 25th, 2018, Huai’an Environmental Protection Bureau issued the “Decision on the Administrative Reconsideration by Huai’an Environmental Protection Bureau {Decision on Reconsideration [2018] No. 2)”, upholding the administrative penalty imposed by the bureau on “Jinhu Zhuochuang Waste Materials Recycling Department”. Jinhu Zhuochuang Waste Material Recycling Department refused to accept the administrative penalty decision, and filed an administrative lawsuit with the People’s Court of Qingjiangpu District, Huai’an City.
